Eligibility & Account Registration

To use EGO Arms you must be at least 18 years of age (21 for handguns where required by your state), a United States resident, and legally permitted under federal and state law to purchase, possess, and receive firearms. By creating an account you represent and warrant that you meet these requirements.

Account Security
  • You are responsible for all activity that occurs under your account. Use a strong, unique password and do not share your credentials.
  • Notify us immediately at security@egoarms.com if you suspect unauthorized access to your account.
  • We will never ask for your password via email, phone, or chat. Any such request is fraudulent.
  • One account per person. Operating multiple accounts is a violation and may result in permanent suspension of all associated accounts.
Identity Verification

EGO Arms reserves the right to require identity verification before approving seller accounts or high-value transactions. Verification may include government-issued ID confirmation. Verification data is handled as described in our Privacy Policy and is never sold.

§ 02

Prohibited Persons & Prohibited Items

Federal Law Notice. It is a federal felony under 18 U.S.C. § 922 for a prohibited person to purchase, possess, or attempt to acquire a firearm. By using this platform you certify that you are not a prohibited person as defined under federal law. Providing false information to facilitate a firearms transaction is a federal crime punishable by up to 10 years imprisonment.
Who May Not Use EGO Arms
  • Any person convicted of a felony or crime punishable by more than one year imprisonment
  • Fugitives from justice
  • Persons adjudicated as mentally defective or committed to a mental institution
  • Unlawful users of or addicted to any controlled substance
  • Persons subject to certain domestic violence restraining orders
  • Persons convicted of a misdemeanor crime of domestic violence
  • Any person who has renounced their U.S. citizenship or is an illegal alien
  • Persons dishonorably discharged from the U.S. Armed Forces
What May Not Be Listed
  • Fully automatic weapons unless lawfully registered under the National Firearms Act (NFA) with all required documentation
  • Short-barreled rifles and shotguns (SBR/SBS) unless properly NFA-registered
  • Suppressors/silencers unless NFA-registered with a valid Form 4
  • Firearms with removed, altered, or obliterated serial numbers
  • Stolen firearms
  • Straw purchase transactions of any kind
  • Firearms illegal to possess in the buyer's or seller's state without exception
  • Destructive devices, explosive ammunition, or armor-piercing handgun ammunition
§ 03

Bidding Rules

All bids placed on EGO Arms are legally binding commitments to purchase at the bid price. Bidding frivolously, retracting bids without cause, or failing to complete a legitimate winning transaction will result in account suspension.

Proxy Bidding

EGO Arms uses a proxy (automatic) bidding system. When you enter a maximum bid, the system bids incrementally on your behalf only as needed to keep you as the high bidder, up to your stated maximum. Your maximum bid is not disclosed to other bidders or sellers.

Anti-Sniping Policy

Any bid placed within 5 minutes of auction close automatically extends the auction by 5 minutes. This ensures all bidders have a fair opportunity to respond. Extensions may chain — there is no hard cap on the number of extensions, though an auction with active bidding will never be cut short by a last-second bid.

Reserve Prices

Sellers may set a confidential reserve price. Listings display whether or not the reserve has been met. If an auction ends without meeting the reserve, no sale is completed and neither party is obligated to transact.

Buy Now

A Buy Now option, when listed, allows immediate purchase at a fixed price that ends the auction instantly. Once a Buy Now is confirmed it cannot be retracted — you are committed to the purchase.

No Buyer's Premium. EGO Arms charges zero buyer's premium. The price you bid is the price you pay. There is no mandatory platform fee on sellers. A 6.5% fee applies only when sellers use GunTab for payment.
§ 04

Seller Obligations

Sellers on EGO Arms agree to the following standards as a condition of listing. Failure to meet these standards may result in listing removal, payment holds, or account suspension.

Accurate Descriptions
  • All listed specifications must be accurate to the best of the seller's knowledge. Material misrepresentations are grounds for cancellation and chargeback of funds.
  • Round count must be disclosed as accurately as possible. "Unknown" is acceptable; knowingly understating round count is not.
  • All known defects, modifications, and cosmetic flaws must be disclosed in the condition section. EGO Arms' required flaw disclosure field is not optional.
Photography Requirements

Sellers must provide at minimum six photographs meeting EGO Arms' photo standard: left profile, right profile, muzzle end, action/chamber, grip area, and serial number (partially redacted). Photos must be of the actual firearm being sold, not stock images.

Shipping
  • Sellers must ship within 3 business days of receiving payment confirmation from EGO Arms.
  • All handguns must ship via overnight service. Long guns may ship via USPS Priority Mail or equivalent.
  • All shipments must be fully insured for the sale price and require adult signature upon delivery.
  • Firearms must only be shipped to a licensed FFL dealer — never directly to an individual buyer.
Platform Fee

EGO Arms charges no mandatory platform fee to sellers. A 6.5% service fee applies only when the seller uses GunTab as their payment method. Off-platform payments (Zelle, Cash App, PayPal Friends & Family) carry no EGO Arms fee. No fee is charged on unsold listings or auctions that end without a winning bid.

§ 05

Payment

EGO Arms does not process payment card transactions. Payments are made directly between buyers and sellers via mutually agreed methods (Zelle, PayPal Friends & Family, Cash App, or Direct Payment). See our Payment Guide for details on each method.

Direct Payment

When using Direct Payment, buyers pay sellers directly off-platform of the firearm through their FFL dealer.

  • Buyers are encouraged to confirm receipt promptly. Disputes must be filed within 14 days of FFL transfer.
  • If a dispute is filed within the 14-day window, payment arrangement is frozen until the dispute is resolved.
  • If a seller fails to ship within 5 business days or a background check results in a denial, the buyer is entitled to a full refund coordinated through EGO Arms support.
Payment Methods

If a buyer and seller agree to a off-platform payment method, EGO Arms is not a party to that transaction and cannot mediate, recover, or guarantee funds. Buyers using off-platform methods accept full counterparty risk. EGO Arms recommends Zelle for most transactions.

§ 06

FFL Transfers

All regulated firearms (modern handguns, rifles, and shotguns) sold through EGO Arms must be transferred through a licensed Federal Firearms Licensee (FFL). This is a federal legal requirement, not an EGO Arms policy choice.

  • The buyer is responsible for selecting a licensed FFL dealer to receive the transfer. EGO Arms' FFL Network lists 2,400+ partner dealers, but any licensed FFL nationwide may be used.
  • The buyer is responsible for all FFL transfer fees charged by their chosen dealer. These fees are not included in the listing price.
  • The buyer must pass a NICS background check administered by the receiving FFL. If the check results in a denial, the firearm is returned to the seller and payment arrangement is refunded to the buyer, less actual shipping costs.
  • Antique firearms (manufactured before 1899) and certain Curios & Relics may be transferred directly under applicable law. Buyers are responsible for verifying the applicable legal exemptions in their jurisdiction.
FFL Transfer Fee Transparency. EGO Arms does not receive any portion of FFL transfer fees. The fee is paid entirely to the receiving dealer for their services. Transfer fees typically range from $20 to $75 depending on the dealer.
§ 07

Disputes & Returns

EGO Arms provides a dispute process for platform-mediated transactions. Off-platform transactions are not eligible for EGO Arms mediation.

Filing a Dispute

Buyers have 14 days from the date of FFL pickup to file a dispute. Disputes must be filed via the dispute form in your account dashboard and must include documentation of the specific issue (photos of discrepancy, written description).

Valid Grounds for Dispute
  • Firearm materially does not match the listing description (e.g., condition significantly overstated, undisclosed damage)
  • Seller shipped the wrong firearm
  • Firearm arrived damaged due to seller's improper packing
  • Seller failed to ship within the 5-business-day window
Not Valid Grounds for Dispute
  • Buyer's remorse — all bids are binding commitments
  • NICS background check denial — this is a federal determination, not a listing issue
  • Minor cosmetic details within normal wear for the stated condition grade

EGO Arms acts as a neutral mediator. Our decision in disputes is final and binding as a condition of using the platform. In clear-cut cases of seller fraud or material misrepresentation, EGO Arms may issue refunds from the seller and suspend the seller's account pending review.

§ 08

Account Suspension & Termination

EGO Arms reserves the right to suspend or permanently terminate any account that violates these Terms of Service, engages in fraudulent activity, or poses a legal or safety risk.

Grounds for Immediate Suspension
  • Listing a prohibited item or attempting to circumvent FFL transfer requirements
  • Providing materially false information on a listing
  • Non-payment after winning a bid without valid cause
  • Confirmed straw purchase arrangement
  • Operating multiple accounts
  • Any activity that suggests the account may be operated by or for a prohibited person
Pending Transactions at Suspension

If an account is suspended with pending transactions, EGO Arms will notify the affected parties and work to facilitate resolution. Because all payments are arranged directly between buyers and sellers off-platform, EGO Arms does not hold or control funds. Buyers and sellers are advised to document their transactions and contact support at ego-arms-contact.html for assistance.

Appeals

Suspended users may appeal to appeals@egoarms.com within 30 days of suspension notice. Appeals are reviewed by a member of the EGO Arms Trust & Safety team not involved in the original decision.

§ 09

Limitation of Liability

EGO Arms is a marketplace platform that connects buyers and sellers. We are not a party to individual transactions between users except as described in the payment methods section above.

EGO Arms is not liable for: the accuracy of user-provided listing information; the outcome of NICS background checks; the conduct of FFL dealers; the physical condition of firearms after transfer; any illegal use of a firearm following a completed sale; or any consequential, incidental, or punitive damages arising from use of the platform.

Our aggregate liability to any user for any claim arising from use of the platform is limited to the total fees paid by that user to EGO Arms in the 12 months preceding the claim.

EGO Arms is not a firearms dealer, broker, or manufacturer. We do not take possession of any firearm at any point in a transaction. All legal obligations for lawful transfer rest with the licensed FFL dealer handling the transfer.
§ 10

Governing Law & Changes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions. Any dispute not resolved through EGO Arms' internal dispute process shall be resolved by binding arbitration under the rules of the American Arbitration Association.

EGO Arms may update these Terms at any time. Material changes will be communicated via email and a notice in your account dashboard at least 14 days before taking effect. Continued use of the platform after that date constitutes acceptance of the updated Terms. If you disagree with a change, you may close your account before the effective date.

We operate in an industry where personal data is especially sensitive — firearms purchases, identity, and location all carry real privacy stakes. We've designed our data practices around collecting as little as necessary to run the marketplace safely and legally. Here's what that means in practice:

We never sell your personal data to third parties
We never store your payment card numbers
We don't share your purchase history with advertisers
You can request deletion of your account and data
We notify you promptly of any breach affecting your data

§ 02

What We Never Collect

No payment card data. EGO Arms does not process, store, or transmit payment card numbers, bank account numbers, or routing numbers. Payments happen off-platform between buyers and sellers directly. We have no access to your payment credentials.
  • ATF Form 4473 data. The background check form is completed at the FFL dealer's location. We never see, receive, or store any Form 4473 data. That information stays with the FFL and ATF as required by federal law.
  • NICS check results. The outcome of background checks is transmitted directly between the FFL and the FBI NICS system. We receive no record of the result.
  • Social Security Numbers. We do not collect SSNs at any point.
  • Government ID numbers. During identity verification we confirm that a government ID was presented and verified, but we do not store the full ID number or a copy of the document.
  • Location tracking. We do not use GPS or continuous location tracking. We collect your stated state of residence (required for compliance) but we do not track your physical location.
  • Third-party advertising data. We do not use advertising pixels, third-party tracking cookies, or behavioral advertising profiles. We do not share your data with ad networks.
§ 03

How We Use Your Data

  • Operating the marketplace. Processing bids, facilitating transactions, coordinating FFL transfers, and disbursing seller payments.
  • Legal compliance. Verifying user eligibility, maintaining records required by federal and state law, and responding to lawful legal process.
  • Security and fraud prevention. Detecting account compromise, shill bidding, listing fraud, and straw purchase patterns.
  • Dispute resolution. Reviewing transaction communications and records when a dispute is filed by a party to that transaction.
  • Service communications. Bid notifications, auction end alerts, shipping updates, and security alerts. We do not send promotional emails without your explicit opt-in.
  • Platform improvement. Understanding aggregate usage patterns (never individual surveillance) to improve search, listings, and performance.

We do not use your data to build advertising profiles, sell to data brokers, train AI models, or any other purpose not listed above.

§ 04

Who We Share Your Data With

We share data only when necessary to operate the transaction or when legally required. We do not sell data. Period.

Counterparty in a Transaction

When you win an auction, the seller receives your chosen FFL dealer's name and address so they can ship the firearm. The seller does not receive your personal contact information directly. When you sell, the buyer receives your seller username and rating — not your personal address.

FFL Dealers

The receiving FFL dealer will know that a firearm is being shipped to them for transfer. As part of the transfer process, the FFL will collect your information directly for the Form 4473 — that information goes to them and the ATF, not to EGO Arms.

Service Providers

We use a limited number of vetted service providers who operate under strict data processing agreements: cloud hosting (for platform infrastructure), email delivery (for notifications), and identity verification (for seller onboarding). These providers process data only on our behalf and may not use it for any other purpose.

Law Enforcement & Legal Process

We will disclose user data to law enforcement when required by a valid legal order (subpoena, court order, or search warrant). We review all such requests carefully. We will not voluntarily disclose data beyond what is legally compelled. Where permitted by law, we will notify you of legal process directed at your account before complying, unless prohibited by the order itself or unless doing so would endanger someone.

Firearms trace requests. If ATF or law enforcement presents a lawful request related to a specific firearm, we are legally required to cooperate. We maintain transaction records as required by applicable law. We do not maintain records beyond what is legally required.
§ 05

Firearms & Privacy — What This Means Specifically

We operate at the intersection of marketplace privacy and federal firearms law. This section explains the practical limits of what we can and cannot protect on your behalf.

  • Your purchase history on EGO Arms is not a federal record. The only federal record of a firearms transaction is the Form 4473 held by the transferring FFL. EGO Arms records are separate from and not part of that federal system.
  • We do not share your purchase history with insurance companies, employers, or background check companies. Our transaction data is not sold or licensed to any commercial data aggregator.
  • Your watchlist and browsing history are private. Items you watch or search for are not shared with sellers, other users, or third parties.
  • Seller usernames are pseudonymous by design. You are not required to use your real name as your seller username. Your legal identity is verified for compliance, but your public-facing seller identity is your chosen username.
  • We do not retain records beyond legal requirements. Once legal retention periods expire, transaction data is purged from our active systems.
§ 06

After retention periods expire, data is permanently deleted from our systems. We do not archive or anonymize data to extend retention — deletion means deletion.

§ 07

Your Rights

Regardless of your state, EGO Arms extends the following rights to all users:

Access

You can request a complete export of the personal data we hold about you. We will provide this in a portable, machine-readable format (JSON) within 30 days of your verified request.

Correction

If any data we hold about you is inaccurate, you can request correction. Account information can be updated directly in your profile settings.

Deletion

You can request deletion of your account and personal data. We will honor this request, subject to legal retention requirements (e.g., transaction records required by federal law cannot be deleted early). We will clearly tell you what can be deleted immediately and what must be retained and for how long.

Opt-Out of Non-Essential Communications

You can opt out of all non-essential communications (newsletters, feature announcements) at any time from your account settings or via the unsubscribe link in any email. You cannot opt out of transactional communications tied to active auctions or open disputes — those are necessary for the service to function.

How to Exercise Your Rights

Submit privacy requests to privacy@egoarms.com from the email address associated with your account. We will verify your identity before processing the request. There is no fee for exercising these rights.

California (CCPA), Virginia (VCDPA), Colorado (CPA), and other state privacy laws. We comply with all applicable state privacy laws. If your state grants additional rights beyond those listed above, those rights apply to you. Contact us if you have questions about your state-specific rights.
§ 08

Security

We treat security as a core function, not a compliance checkbox. Given the sensitivity of firearms marketplace data, we apply measures beyond typical consumer platforms.

  • Passwords are hashed using bcrypt with a cost factor appropriate to current hardware. We never store plaintext passwords and cannot recover them — only reset them.
  • All data in transit is encrypted via TLS 1.2 or higher. We enforce HTTPS across the entire platform with HSTS.
  • Data at rest is encrypted using AES-256 on all production databases.
  • Access controls: Internal access to production user data is restricted to a small number of authorized employees, requires multi-factor authentication, and is logged. We operate on a least-privilege model.
  • Penetration testing is conducted at minimum annually by an independent third party. Critical findings are remediated within 72 hours.
  • Admin panel access requires multi-factor authentication and is restricted by IP allowlist. The admin panel is not accessible from the public internet without VPN.
Breach Notification

In the event of a data breach affecting your personal information, we will notify you via email within 72 hours of becoming aware of the incident — faster than most legal requirements mandate. Our notification will describe what data was affected, what we are doing about it, and what steps you should take.

Responsible Disclosure

If you discover a security vulnerability in EGO Arms, please report it to security@egoarms.com. We will respond within 24 hours, will not pursue legal action against good-faith researchers, and will credit researchers publicly (with permission) upon remediation.

Cookies & Tracking

We use cookies and similar technologies minimally and only for functional purposes:

We do not use analytics cookies from third parties (e.g., Google Analytics). We do not use advertising cookies or tracking pixels. Our analytics are self-hosted and anonymized — individual browsing sessions are not stored or linked to your account.

We will update this Privacy Policy as our practices change or as required by law. For material changes — changes that meaningfully affect how we collect, use, or share your personal data — we will notify you by email at least 30 days before the change takes effect and give you the option to delete your account if you disagree.

Minor clarifications and corrections (fixing typos, adding examples, clarifying existing practices without changing them) may be made without advance notice, but the effective date at the top of this page will always be updated.

This Privacy Policy applies to information collected by EGO Arms LLC through egoarms.com. It does not govern data collected by FFL dealers, payment service providers, or any other third party, even if you accessed them through our platform.
California Residents
California Consumer Privacy Act (CCPA) Rights

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with the following rights regarding your personal information. These rights are in addition to those described elsewhere in this Privacy Policy.

Right to Know

You have the right to request that we disclose what personal information we collect, use, disclose, and sell. You may submit a request to know by emailing privacy@egoarms.com or using our Contact form. We will respond within 45 days of a verifiable request.

Right to Delete

You have the right to request deletion of personal information we have collected from you, subject to certain exceptions (such as information required to complete a transaction, detect security incidents, or comply with legal obligations).

Right to Opt-Out of Sale

EGO Arms does not sell personal information to third parties. We do not share user data for cross-context behavioral advertising. There is nothing to opt out of, but we acknowledge this right.

Right to Non-Discrimination

We will not discriminate against you for exercising any CCPA rights. You will not be denied services, charged different prices, or provided a lower quality of service because you exercised a privacy right.

Authorized Agent

You may designate an authorized agent to submit CCPA requests on your behalf. We may require proof of identity and authorization before processing a request submitted by an agent.

To submit a CCPA request: Email privacy@egoarms.com with subject line "CCPA Request" and specify the right you are exercising (Know, Delete, Opt-Out). We will verify your identity using information already on file before responding.

Seller Eligibility & Verification
