NFA Items 101: Suppressors, SBRs, and the Form 4 Process

NFA items — suppressors, short-barreled rifles, machine guns, and a few other regulated firearm types — sit in a separate legal category from standard firearms. The process for buying one at auction is the same in principle, but involves more paperwork, more waiting, and a tax stamp that has to clear before you can take possession.

Here's everything you need to know before you bid on your first NFA item.

What Is an NFA Item?

The National Firearms Act (1934) requires federal registration of specific firearm types. When you see an NFA item on EGO Arms, it is already registered — you're transferring that registration to yourself, not creating a new one (with limited exceptions).

The Form 4 Transfer Process

Unlike a standard firearm transfer (Form 4473 at your FFL), NFA transfers use ATF Form 4 — Tax Paid Transfer and Registration. The process:

1. Win the auction. The seller holds the item (it cannot be shipped to a non-SOT dealer or directly to you).
2. Identify a Class III SOT dealer near you. Your receiving FFL must be a Special Occupational Taxpayer (SOT) — a Class III dealer. Not all FFLs are SOTs. EGO Arms' FFL network identifies SOT dealers.
3. Seller ships to your SOT dealer. The item transfers to your dealer's inventory (not to you) while the ATF paperwork processes.
4. Complete ATF Form 4. Your SOT dealer will guide you through this. You'll need: passport photos, fingerprint cards (typically taken at the dealer), and CLEO notification (Chief Law Enforcement Officer of your county — notification only, not approval). The ATF tax stamp fee is now $0 for all NFA items including AOW.
5. Wait for ATF approval. This is the famous NFA wait. See times below.
6. ATF returns the approved Form 4. You take possession, complete a standard 4473, and the item is yours. Keep the approved Form 4 with the item whenever transporting it.

Trust vs. Individual Transfer

You have two options for how to take ownership: as an individual, or through an NFA trust (a legal entity you create specifically to own NFA items). Trusts were more popular before the 2016 ATF Rule 41F, which eliminated the CLEO approval requirement for individuals. Today, individual transfers are generally simpler. The main reason to still use a trust: you can name multiple trustees, allowing other household members to legally possess the item without requiring a separate transfer.

State Laws Matter — A Lot

Several states ban civilian ownership of suppressors and/or SBRs entirely: California, New York, New Jersey, Illinois, Massachusetts, Rhode Island, Hawaii, and the District of Columbia among others. Before bidding on any NFA item, verify your state permits that specific NFA category. Winning an auction for an item you can't legally own in your state creates an expensive problem.
